Ok now I'm paralyzed in fear. What the frisnick am I supposed to do now?! Get a real job? I'm trying! I'm trying! Shit am I trying.
My last final is today! Well, I gotta go on Friday because when I was giving my presentation I broke the computer and yeah...I was pissed off! I stood up there for like ten minutes, face red as hell cause I was embarrassed that I had broke the computer and everyone was staring at me. Stupid technology! So I've devised a new plan so that doesn't happen again. Cause if it does I'll curl up in a ball and cry.
In order to celebrate the end of the year, and as a belated birthday gift to me from my roommate, BREWERS GAME TONIGHT! What up! Ye-yah punks! Going to see my fellas! If you're able to watch the game then do so because let me tell ya, we are making it on TV tonight. Oh yes Clarice we are! I can't say what our plans are since we're going for the "wow" factor. My mom knows since she came down here the other day and I had to show someone. It should be good. Yes indeedly do.
Eek. I should be studying. Want to know some mass communication's law? Alright! Here's a little diddy for you. Porno is not a legal term. Its intent is for sexual arousal. Obscenity is a legal term, has no first amendment protection and you aren't gonna find in on the airwaves. Also it is hard to define something as obscene. Indecency is also a legal term, a shade less then obscenity and also you really aren't going to see much of it in broadcast except that there are safe harbor laws! Yes! In the great country of America we protect indecent material so you can get your TV shows with all the explicits between the hours of 10pm and 6am! Only it isn't good PR so most of the time you aren't gonna see it.
PS did you know that back in the 60s-70s before the Miller v. California Supreme Court decision the justices used to watch spankables in the Court basement? Yeah! They did it cause they were getting so many cases about indecent vs. obscene. Talk about your tax money at work! But then the decision as handed down and the porno nights ended.
Also in WI you can only close a public meeting for five reasons. Guesses? Anyone? no? talking with counsel, negotiation of property and labor, personnel matters and talking about crime detection and prevention. Interesting to note that at both the Fed and state level there are no statutes about open meetings in congress.
Oh, this rambling is testing my brain in a fun way! Sorry if anyone actually read this hoping for something good...which then why read this blog to start out with if that is your intent? oooh and there goes the self esteem...right. Yeah. Uh huh.
Can you put a gag order on the press? Mmm yes but have fun meeting the criteria. Nebraska Press Test! 1) pretrial coverage would be intense and pervasive 2) no alternative measures could offset the coverage and 3) the order would really help prevent prejudicial influence. See the one that is the sticking point is number two. You can always sequestion the jury, screen jurors, warn the jury or haul in one from a different town.
I could go in to FCC v. Pacifica and how if ties in with Red Lion v. FCC and Miami Herald v. Tornillo but I'll spare you since I know that one real good since I wrote a term paper about Miami Herald.... But it is interesting to note that there is a right of reply in broadcast for political candidates but there isn't one in print.
Did you know that "puffery" is a legal term? First off, number one word I want to hear a Supreme Court Justice say behind the phrase "sexual arousal" or something to that effect.
Right...I think I've went on long enough about comm. law. I don't mind learning about it but I'm sure others do. So...
